These Terms and Conditions (“Terms”) govern the use of inbkeurope.com (the “Website”) and the purchase of products offered under the INBK brand through the Website.
Please read these Terms carefully before placing an order. By placing an order through the Website, you confirm that you have read and understood these Terms and agree to be bound by them.
Nothing in these Terms limits any mandatory consumer rights that apply to you under applicable law.

Individual Entrepreneur Igan Nait acts as the seller of products purchased through the Website unless expressly stated otherwise.
INBK is a Ukrainian accessories brand specialising in cosmetic bags, bags and textile accessories.
2. GENERAL PROVISIONS
These Terms apply to all orders placed through the Website.
By placing an order, you confirm that you have the legal capacity to enter into a purchase contract or that you are acting with the consent of your legal representative where required by applicable law.
For the purposes of these Terms, a “Consumer” means an individual purchasing products primarily for purposes outside their trade, business, craft or profession.
Mandatory consumer rights applicable in the Consumer’s country of habitual residence remain unaffected by these Terms.
3. PRODUCTS
We make reasonable efforts to ensure that all product descriptions, photographs, colours, dimensions, materials and other information displayed on the Website are accurate.
However, colours may appear slightly different depending on the screen, device settings and lighting conditions used to view the Website.
INBK products are textile products and certain products involve manual production processes.
As a result, minor variations in dimensions, stitching, fabric texture, pattern placement or finishing may occur between individual products.
Such minor variations that are inherent to textile materials or manual production and do not materially affect the appearance, functionality or quality of the product are not necessarily considered defects.

4. AVAILABILITY
All products and orders are subject to availability.
Adding a product to your shopping cart does not reserve that product.
If a product becomes unavailable after you have placed an order, we will contact you as soon as reasonably possible.
If we are unable to fulfil the order, any payment received for the unavailable product will be refunded.
5. PRICES
Product prices are displayed on the Website in the currency indicated on the relevant page or during checkout.
The price applicable to an order is the price displayed at the time the order is submitted.
Any delivery charges or other charges collected by INBK will be displayed before the Customer completes the order.
Where additional charges cannot reasonably be calculated in advance, information about the possibility of such charges will be provided where required by applicable law.
INBK may change its prices at any time. Such changes do not affect orders already accepted by INBK.
6. PLACING AN ORDER
To place an order, select the desired product and available options, add it to your shopping cart and follow the checkout process.
Before completing your order, you will have an opportunity to review the products selected and the information you have provided.
You are responsible for ensuring that your name, email address, telephone number, billing information and delivery address are complete and accurate.
By submitting an order through the Website, you acknowledge that the order entails an obligation to pay.
After the order has been submitted, you will receive an electronic confirmation at the email address provided during checkout.
7. CONCLUSION OF THE CONTRACT
The display of products on the Website constitutes an invitation to place an order.
A purchase contract between you and INBK is concluded when your order is accepted by INBK and you receive confirmation that the order has been accepted or is being processed for fulfilment.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
• the product is unavailable;
• payment cannot be authorised or processed;
• incorrect information has been provided;
• an obvious pricing or technical error has occurred;
• fraudulent or unauthorised activity is reasonably suspected;
• delivery to the specified destination is not available.
If we cancel an order after payment has been received, the applicable amount will be refunded.
8. PAYMENT
Available payment methods are displayed during checkout.
Payments may be processed through:

PayPal
and any other payment methods that may subsequently be made available on the Website.
Payment transactions may be processed directly by the relevant third-party payment provider and are also subject to that provider’s applicable terms and privacy practices.
INBK does not directly store full payment card details where those details are processed by a payment service provider.
The Customer must pay the full amount indicated during checkout unless another payment arrangement is expressly offered on the Website.
9. SHIPPING AND DELIVERY
INBK ships orders to the countries and territories available during checkout.
Available delivery methods, estimated delivery times and delivery costs will be displayed on the Website or during checkout.
Delivery times are estimates unless a specific delivery date has expressly been agreed.
Orders may be shipped using third-party postal, courier and logistics providers.
Customers are responsible for providing accurate and complete delivery information.
INBK is not responsible for delays caused by incorrect or incomplete delivery information provided by the Customer.
Unless another delivery period has been agreed, orders covered by applicable EU consumer rules will be delivered within the period required by those rules.

10. INTERNATIONAL ORDERS, CUSTOMS AND TAXES
INBK is established in Ukraine and sells products internationally.
Depending on the destination country, delivery method, value of the order and applicable legislation, shipments may be subject to import VAT, customs duties, brokerage fees or other import-related charges.
Where such charges are collected directly during checkout, they will be included or identified as part of the order.
Where they are not collected by INBK, additional charges may be imposed by the relevant customs authority, postal operator, courier or other competent party.
Where required by applicable law, Customers will be informed before purchase about the possibility of additional charges that cannot reasonably be calculated in advance.
11. RIGHT OF WITHDRAWAL
Consumers who are entitled to a statutory right of withdrawal under applicable consumer law may withdraw from an eligible online purchase without giving any reason.
For Consumers protected by applicable EU distance-selling legislation, the withdrawal period is generally 14 days from the day on which the Consumer, or a third party designated by the Consumer other than the carrier, receives the goods.
Where several goods forming one order are delivered separately, the withdrawal period generally begins when the final item is received.
To exercise the right of withdrawal, you must inform INBK of your decision by a clear statement before the withdrawal period expires.

12. RETURNS
After informing us of your decision to withdraw, eligible products must be returned within the period required by applicable law.
Please contact us before sending a return so that we can provide the current return instructions and return address.
Do not automatically send returns to our registered business address in Kyiv unless instructed to do so by INBK.
Products should be returned with reasonable care and, where possible, with their original packaging, labels and accessories.
The Customer may inspect a product only to the extent reasonably necessary to establish its nature, characteristics and functioning.
Where permitted by applicable law, the Customer may be responsible for diminished value caused by handling beyond what is reasonably necessary for such inspection.
Unless INBK agrees otherwise or applicable law requires otherwise, the Customer bears the direct cost of returning a product when exercising the statutory right of withdrawal.
13. REFUNDS
When a valid statutory right of withdrawal is exercised, INBK will reimburse the payments required to be reimbursed under applicable law.
Refunds will normally be issued using the same payment method used for the original transaction unless another method is expressly agreed.
Where permitted by applicable law, INBK may withhold reimbursement until the returned goods have been received or until the Customer provides evidence that the goods have been sent back, whichever occurs first.
Additional costs resulting from the Customer choosing a delivery method more expensive than the standard delivery method offered by INBK may not be refundable where permitted by applicable law.
14. PRODUCTS EXCLUDED FROM WITHDRAWAL
The statutory right of withdrawal may not apply where an exception is provided by applicable law.
This may include, in particular, products made to the Customer’s specifications or products that are clearly personalised.
For example, an INBK product individually customised with a Customer’s name, initials, personalised embroidery or another individually requested feature may be excluded from the right of withdrawal where the applicable legal requirements for that exception are satisfied.
Standard INBK products are not considered personalised merely because they are produced or prepared after an order is placed.
15. DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
If you receive a product that is defective, damaged or different from the product ordered, please contact us at:

Nothing in these Terms limits statutory rights relating to defective or non-conforming products.
Where required by applicable consumer law, appropriate remedies may include repair, replacement, price reduction or refund.
16. PRODUCT CARE
Customers should follow any care instructions supplied with the product or displayed on the Website.
Damage caused by improper use, failure to follow reasonable care instructions, normal wear and tear or accidental damage after delivery is not considered a manufacturing defect, except where applicable law provides otherwise.
17. PROMOTIONS AND DISCOUNT CODES
INBK may occasionally offer discounts, promotional campaigns or promotional codes.
Specific promotions may be subject to additional conditions.
Unless otherwise stated, promotional codes cannot be exchanged for cash, applied retrospectively or combined with other promotional offers.
INBK may establish expiry dates or product restrictions for promotional codes.
18. INTELLECTUAL PROPERTY
All intellectual property associated with the Website and INBK brand, including the INBK name, trademarks, logos, product designs, photographs, videos, graphics, texts, product descriptions and visual materials, belongs to INBK or is used with appropriate permission.
Website content may not be reproduced, copied, distributed, modified or commercially exploited without prior permission from the relevant rights holder, except where permitted by applicable law.
19. PERSONAL DATA
Personal data collected through the Website is processed in accordance with our Privacy Policy and applicable data protection legislation.

20. WEBSITE USE
You must not use the Website:
• for unlawful or fraudulent purposes;
• to interfere with the operation or security of the Website;
• to attempt unauthorised access to our systems;
• to transmit malicious software;
• to infringe the intellectual property or other rights of INBK or third parties.
We may temporarily restrict access to parts of the Website where reasonably necessary for maintenance, security or technical reasons.
21. LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the maximum extent permitted by applicable law, INBK is not responsible for indirect or unforeseeable losses that were not reasonably foreseeable at the time the purchase contract was concluded.
Nothing in this section affects mandatory rights or remedies available to Consumers under applicable consumer law.
22. FORCE MAJEURE
INBK will not be responsible for delays or failure to perform obligations caused by circumstances outside our reasonable control, to the extent permitted by applicable law.
Such circumstances may include natural disasters, war, hostilities, governmental restrictions, major transportation disruptions, strikes, telecommunications failures and other extraordinary events outside our reasonable control.
If such circumstances materially affect an order, we will make reasonable efforts to inform the Customer and provide an appropriate solution.
23. GOVERNING LAW AND CONSUMER PROTECTION
These Terms and contracts concluded through the Website are governed by the laws applicable to the Seller, subject to mandatory consumer protection rules that may apply to Consumers.
Where a Consumer is entitled to mandatory protections under the law of their country of habitual residence, nothing in these Terms is intended to deprive that Consumer of such protection.
We encourage Customers to contact INBK first if a dispute or complaint arises so that we can attempt to resolve the matter directly.
24. CHANGES TO THESE TERMS
INBK may update these Terms from time to time to reflect changes to applicable law, our Website, products, payment methods, delivery arrangements or business operations.
The version applicable to an order will generally be the version in effect when the order was placed.
The latest version of these Terms will be published on the Website together with the date of the most recent update.
